Telephone Consumer Protection Act (TCPA)

It is very common for creditors or debt collection agencies to contact consumers using “auto-dialers.”  This means they use a computer to contact thousands of consumers per day and use computer-generated messages to attempt to collect debts.  These calls are usually a violation of the Telephone Consumer Protection Act, which prohibits the use of this technology to contact consumers without their prior consent.

Common violations include:

  • Leaving computer-generated voice messages on consumers cell phones without their express consent
  • Sending computer-generated text messages on consumers cell phones without their express consent
  • Auto-dialing consumers about sales or telemarketing campaigns on their cell phones or landlines without their express consent
  • Sending computer-generated text messages about sales or telemarketing campaigns to consumers without their express consent
  • Repeatedly making “hang-up calls to consumers cell phones without their express consent
