FAIR DEBT COLLECTION PRACTICES ACT

Debt collection companies are not permitted to use any means necessary to collect a debt. You have rights. The Fair Debt Collection Practices Act (“FDCPA”) places strict limitations on what a debt collector can and cannot do when seeking payment on an overdue account. Our consumer rights attorneys use federal law to turn the tables on these unreasonable debt collectors.

We can stop collectors from harassing you. In fact, our lawyers may be able to bring a claim against the debt collection company for failing to abide by the laws that are in place to protect you from harassment. We can protect you from:

  • Illegal collection phone calls and voice mails
  • Harassing letters
  • Collection calls to your family or place of employment
  • Use of profane language
  • Threats of legal action (lawsuits, garnishing wages)
  • False statements

If you are receiving calls, contact us today for a free consultation. Our attorneys are here to help you put an end to the harassment.

TELEPHONE CONSUMER PROTECTION ACT

The use of “robo-dialing” technology by debt collectors is becoming more and more common. The Telephone Consumer Protection Act (“TCPA”) prohibits the use of this technology to contact consumers on their cell phones without their express consent. However, many companies violate this federal law by using this technology to bombard consumers with an enormous number of calls.

This means that when you receive a call, voice mail or text message that was computer-generated or contains a prerecorded message, there is likely a TCPA violation. You don’t need to stand by and accept this harassment.

FAIR CREDIT REPORTING ACT

The Fair Credit Reporting Act is designed to regulate the use of consumer credit information in a manner that is fair to the consumer, with regard to the confidentiality, accuracy, relevancy and proper utilization of such information.

In general, the FCRA requires financial institutions to notify consumers when adverse action has been taken and requires Consumer Reporting Agencies (like Trans Union, Equifax and Experian) to disclose consumer reports to individuals, to investigate disputed information, and to correct errors. The FCRA also restricts the use of consumer reports and requires the deletion of information older than prescribed periods.

Common Violations:

  • Inaccurate reporting on credit history as to the amount or the date of activity
  • Reporting credit information on wrong person’s credit file
  • Failing to properly investigate a consumer’s dispute of a reported item
  • Failing to keep consumer credit information confidential

If you believe that an item on your credit report is inaccurate, contact us today for a free consultation at (816) 994-6200.
